# FDA "Certified" Food Packaging Doesn't Exist — Here's What to Verify Instead

Search for food packaging suppliers and you'll see "FDA certified" everywhere. Here's the uncomfortable truth: the U.S. FDA does not issue certificates to packaging factories. What actually exists is *compliance* with FDA food-contact regulations (21 CFR) — demonstrated through third-party lab testing. Knowing the difference protects your business from customs holds and liability.

## The certifications that actually exist (and what each covers)

| Document | Issued by | What it proves | Who needs it |

|---|---|---|---|

| FDA food-contact compliance (21 CFR test report) | Third-party labs (SGS, Intertek, etc.) | Materials don't migrate harmful substances into food under intended use | Anyone selling into the US |

| EU LFGB test report | Third-party labs | Stricter German/EU food-contact standard, incl. sensory testing | EU market, esp. Germany |

| ISO 9001 | Accredited certification bodies | The factory's quality management system | All buyers — factory consistency |

| BPI Compostable | Biodegradable Products Institute | Product composts in industrial facilities (North America) | US buyers with sustainability claims |

| EN 13432 | EU notified bodies | EU industrial compostability standard | EU buyers with compostable claims |

UNITE EcoPack maintains all five for the relevant product lines — every batch from our Johor factory ships with matching documentation. See our [certifications page](/en/certifications).

## Red flags when a supplier says "FDA certified"

1. A generic "FDA certificate" PDF with no product SKU on it. Real test reports name the exact material and product tested.

2. One report covering "all products". Paper with PE coating, aluminum with lacquer, and inks are tested separately.

3. No issue date or an expired report. Compliance testing should be recent enough to reflect current production.

4. Claims without the lab's name. You should be able to verify the report number directly with SGS/Intertek.

## The 4 documents to request before you order

1. Product-specific food-contact test report for your destination market (FDA 21 CFR for US, LFGB for EU).

2. Coverage of coatings and inks — critical for printed packaging, where non-food-contact inks must stay on the outside surface.

3. Factory quality certificate (ISO 9001) — proves the batch you get in month 6 matches the sample from month 1.

4. Compostability certificate (BPI or EN 13432) *only if* you plan to market packaging as compostable — general "eco-friendly" claims don't require it, but compostable claims legally do in many markets.

## FDA registration vs FDA compliance — the exact difference

- FDA registration applies to *food facilities* (producers of food itself) under the Bioterrorism Act. Packaging factories generally don't register.

- FDA compliance means packaging materials meet 21 CFR food-contact regulations — proven by migration testing.

- So when a packaging supplier says "FDA certified," the *correct* claim behind it should be: "our materials are tested compliant with FDA 21 CFR." Ask to see that test report.

## Frequently asked questions

Does kraft paper with PE coating pass FDA and LFGB?

Our TTGCK/TTGCW kraft and white takeaway series are tested for both — request the current report for the specific SKU with [your quote](/en/contact).

Are aluminum foil containers FDA compliant?

Aluminum itself is food-safe; what needs verification is the lacquer/coating. Our [aluminum foil series](/en/products/aluminum-foil) documentation covers the coated finished container.

Is "biodegradable" the same as "compostable"?

No. Compostable (BPI/EN 13432) is a tested, certified claim with defined timeframes and facilities. "Biodegradable" alone is untested marketing language — several jurisdictions now restrict its use on packaging.

Can you provide documents under my company's name for customs?
